SHIPPING AND DELIVERY CONDITIONS (SHIPPING POLICY)

PREAMBLE & NOTE ON THE OPERATING MODEL

Thank you for your order with Aipax Brands e.K.

Our goal is to provide you with a high-quality and resource-efficient shopping experience. Please note a special feature of our business model: to avoid overproduction and to realize individual designs, we primarily sell and broker products that are not available as finished stock. These items are produced or processed exclusively for you only after your order using the Print-on-Demand (PoD), Made-to-Order or Custom-Made process.

This results in specific procedures for determining the total delivery time, which are legally regulated below.


SECTION A: DELIVERY TIMES & LOGISTICAL PROCESSING

1. Composition of the Total Delivery Time

The period for the delivery of goods is calculated from two consecutive phases: 1. The processing and production time: The period from receipt of payment to completion and handover of the goods to the transport service provider. 2. The transport and delivery time: The period from handover of the goods to the transport service provider to physical delivery to your delivery address.

2. Processing and Production Time (Made to Order)

Since the goods are only custom-made after the order is received, the regular processing and production time is: - Standard production: 2 to 7 working days after successful order confirmation and full payment. - Seasonal deviations: In case of increased order volume (e.g., before holidays, for limited collections, or special promotions), the production time may be extended by up to 3 additional working days in individual cases.

3. Transport and Delivery Time (Shipping Transit Times)

After production is completed and the goods are handed over to one of our decentralized logistics partners, the pure shipping transit time for standard shipping is: - Deliveries within Germany: 2 to 5 working days. - Deliveries to member states of the European Union (EU): 5 to 10 working days. - International deliveries (third countries): 7 to 21 working days (subject to customs clearance time in the destination country).

For payments in advance, the delivery period begins on the day after the payment order is issued to the transferring credit institution; for other payment methods, it begins on the day after the contract is concluded and ends with the expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday, or a public holiday recognized by the state at the place of delivery, the next working day shall take the place of such a day.

4. Partial Deliveries

We are entitled to make partial deliveries to a reasonable extent if your order includes several products that, for logistical reasons, must be produced at different production sites or shipped by different logistics partners (Third-Party Logistics / 3PL). - No additional costs: The customer will not incur any additional shipping or packaging costs due to partial deliveries. - Legal consequence: The statutory deadlines regarding the right of withdrawal for the goods received in each case begin to run separately with the receipt of the respective partial delivery.

5. Reservation of Self-Supply & Force Majeure

Should a product mediated or distributed by Aipax Brands e.K. become unavailable through no fault of our own because a supplier or production partner fails to fulfill their contractual obligations to us, we are entitled to withdraw from the contract. - In this case, we will immediately inform the customer of the unavailability and promptly refund any payments already made. - In case of delays due to force majeure, strike, official orders, or natural disasters, the delivery time will be extended by the duration of the impediment.


SECTION B: TRANSFER OF RISK, CUSTOMS AND EXPORT POLICIES

1. Transfer of Risk during Transport

           For consumers (B2C): If the customer acts as a consumer within the meaning of § 13 BGB (German Civil Code), Aipax Brands e.K. bears the transport risk. This means that the risk of accidental loss and accidental deterioration of the goods passes to the customer only upon delivery of the goods to the customer or a recipient designated by them (§ 475 para. 2 BGB).

           For businesses (B2B): If the customer acts as an entrepreneur within the meaning of § 14 BGB, the risk of accidental loss and accidental deterioration of the goods passes to the customer as soon as we have delivered the goods to the forwarder, carrier, or other person or institution designated to carry out the shipment (§ 447 para. 1 BGB).

2. International Deliveries, Customs and Import Duties

For deliveries to shipping addresses outside the European Union (e.g., Switzerland, United Kingdom, USA), customs duties, import VAT, processing fees, or other charges may apply for the import of goods. - Cost assumption: These import duties are levied by the local customs authorities of the recipient country and must be borne directly by the recipient of the goods (customer). Aipax Brands e.K. has no influence on these fees and cannot predict their amount. - Customs clearance: The customer is responsible for ensuring that the goods can be lawfully imported into the destination country. Delays due to customs inspections are beyond the control of Aipax Brands e.K. and do not constitute a delay on our part.


SECTION C: CUSTOMER COOPERATION OBLIGATIONS & DAMAGE MITIGATION

1. Accuracy of Delivery Address

The customer is obliged to provide a complete, correct, and deliverable shipping address during the order process. - Consequence of incorrect information: If a shipment cannot be delivered due to incomplete or incorrect address details (e.g., missing house number, wrong postal code, missing company name for B2B addresses) and is returned to us or one of our production partners, the customer bears the resulting costs for the return transport. - Second shipment: A renewed shipment of the goods to a corrected address will only take place after the customer has reimbursed us for the renewed shipping and processing costs.

2. Default of Acceptance and Unclaimed Shipments

If the delivery agent cannot hand over the shipment due to the customer's absence and it is deposited at a post office or packing station for collection, the customer is obliged to collect the goods within the period set by the shipping service provider. - Legal consequence of non-collection: If the customer does not collect the shipment, unjustifiably refuses acceptance, or if delivery fails for reasons attributable to the customer, the customer is in default of acceptance (§ 293 BGB). - No revocation through non-acceptance: The mere non-acceptance or non-collection of the goods does not expressly constitute a valid exercise of the statutory right of withdrawal. - Cost reimbursement: We reserve the right to offset the costs incurred by the default of acceptance (return shipping costs of the service provider, storage fees of the logistics partners, and processing fees) against payments already made or to charge them separately to the customer.


SECTION D: INSPECTION UPON RECEIPT (DUTY TO MITIGATE DAMAGE)

1. Transport Damage and Obvious Defects

To successfully assert claims for defects against transport service providers, please observe the following steps: - Inspection upon delivery: Immediately check the package for external damage upon receipt (e.g., tears, dents, moisture). - Documentation: Have obvious damage to the packaging confirmed in writing directly by the delivery person or refuse acceptance in case of severe damage. - Notification to us: Report the transport damage or misprint to us immediately within 7 working days of receipt at Service@Aipax-Brands.com, attaching photos of the damaged item, the shipping box, and the shipping label.

The statutory warranty rights of consumers are not restricted by a delayed or omitted damage report. However, it significantly facilitates our enforcement of compensation claims against the transport companies.
